The vaccine injury liability protection put in place via the 1986 National Childhood Vaccine Injury Act is the single greatest cause of the chronic illness epidemic of the modern age. Mass onset of autoimmune and neurological disorders began with this law that violated American’s 7th Amendment right to sue for injury, and the epidemics will not end until this liability protection for vaccine makers is removed.

In ICAN Legislate’s view, the “End the Vaccine Carveout Act” is a long overdue, necessary law that will have the simple effect of bringing vaccines into line with every other consumer product in our country. Instead of the existing disincentive that liability protections create for vaccine manufacturers, there will be the incentive to make safe products – something that is especially critical when we are talking about products that are injected into healthy babies every day. If these products are as safe as we have been told for decades, then their manufacturers should have to stand behind them. This Act will ensure that this happens.

As a physician who has cared for countless children and families affected by preventable medical harm, I strongly support H.R. 4668. No industry should be shielded from accountability, least of all when it comes to products mandated for our most vulnerable. Ending the vaccine carveout is not only about justice, but it’s about restoring trust in our medical system and ensuring that every patient has the right to be heard, protected, informed, and compensated when injured.

Since the late 1980’s, Americans have not been able to sue vaccine manufacturers or providers when there is vaccine injury or death. The National Childhood Vaccine Injury Act (NCVIA), better known as the 1986 Act, removed liability for harm and death from vaccines and created an alternative to the constitutional legal process. It’s called the Vaccine Injury Compensation Program (VICP), referred to by many as the “Vaccine Court.”

As a result, thousands of Americans have been left stranded by an overwhelmed and underperforming special vaccine court, unable to get support or pursue legal justice for themselves and their loved ones.
